Cake Design.

Client agree to give Nita’s Pastries the freedom of creative changes of the decided design for the sake of stability, structural integrity or other certain emergencies. Clients also understands that although Nita’s Pastries will do its best to match specific colors, and that color matching is not easily perfected. Different mediums such as buttercream, white chocolate have a yellow tint, and will affect the process of color matching. Clients also understands that cake design is a creative art form, and therefore final design is an interpretation of the agreed upon design.

Design Changes

Changes to your desserts or cake order such as size, colors, flavors, and designs will be accepted until 2 weeks prior to the event date. After lockout date, Nita’s Pastries CANNOTaccept any changes. Once deposit is paid, Nita’s pastries and the client agree to the set amount agreed upon. However, any changes made by the client may affect the original pricing. Nita’s Pastries reserves the right to increase or decrease price based on any change made to the design, pattern, size of tiers, quantity, delivery location, etc.

Delivery and Set Up

If you would like to pick up your cake or desserts, please make arrangements beforehand to set up a time that works best for both parties. Please arrive on time to pick up your cake or desserts. Nita’s Pastries ensures that all precautions will be made to stabilize the cake or dessert so that it will survive transport. Once the cake or dessert has left the pickup location, Client is responsible for any damages to the cake or desserts. Because of this, Clients will understand that Nita’s Pastries strongly encourages delivery of any multi-layer cakes. 

We charge a fee of $75.00 for delivery & set up of any multi-layered cake (within 10 miles) of our location, any additional mile will be charge $3 per mile. Delivery of regular cakes & desserts will depend on how far the location is. Nita’s Pastries will arrive approximately 1-2 hours before the event to set up the cake. It’s the job of your venue or event coordinator to contact Nita’s pastries of any time delay or changes. If the venue is not ready for setup and Nita’s pastries was not informed, there will be a 15 mins grace period upon arrival for the venue to complete setup and cake be delivered. After which a penalty fee will be accessed to the customer’s credit card at a rate of $50/hour or fraction thereof.

Upon delivery and set up Nita’s Pastries will take pictures of finished cake. I understand that Nita’s Pastries is not responsible for the cake after delivery & set up has been completed. Any damage caused to the cake or desserts, including but not limited to melting in direct sunlight or high temperature, bumping, scraping, mishandling by moving to a different table, etc. it is recommended to be mindful of the placement of the cake table while deciding the layout of your event.

Number of Servings

I understand that Nita’s Pastries has provided me with the number of estimated servings and it was my choosing for my order, I understand that the serving number may change depending on how the venue kitchen staffs or person responsible for the cake at the event cuts the cake. Nita’s Pastries will not be held responsible if all the guest don’t receive a serving of cake. THERE WILL BE NO REFUNDS.

Company Responsibility

In the case of an unavoidable situation, such as a car accident or poor road conditions during delivery, Nita’s Pastries cannot be held liable for more than the cost of the ordered cake or desserts. In the event of a personal or family emergency, Nita’s Pastries will forfeit all payments and will do their best to find another professional cake designer in the area to take over the order. Nita’s pastries will do its best to negotiate the same pricing that was originally agreed upon. Client is allowed to deny services of a new decorator and simply accept the refund.

Allergy Disclaimer

Nita’s Pastries is not responsible for any medical issues that may arise from consuming the products. Clients is to disclose any known allergen of them or their guest at the time of cake / desserts consultation. However, due to cross contamination, Nita’s Pastries can never guarantee that the products is 100% free of allergens. Clients understands in the case of an extreme allergen or medical condition, Nita’s Pastries  strongly encourages the client to order through another specialized bakery.

Non-Edible Items

Nita’s Pastries will not be responsible for consumption of any non-edible items placed on your cakes or desserts such as, flowers, wires, ribbons, pearls, rhinestone bling wraps, etc. Any non-edible item MUST be removed by the client before the cake or dessert is consumed.

Retainer

At the time of booking, Client is required to pay a NON-REFUNDABLE retainer of 50% of the total order and sign the cake contract agreeing to the set terms. The reatiner is paid to reserve your date and is NON-REFUNDABLE in the event of a cancellation.

Final Payment

The final payment will be due two weeks before the event date. Although Nita’s Pastries will send reminders, it’s up to the client to send final payment prior to event date. If final payment is not received by 7 days prior to event date, Nita’s Pastries will not be held responsible for NOT completing the requested service, and will keep the 50% NON-REFUNDABLE retainer payment already made by the client. Cancelation Policy

In the event of a cancelation, Nita’s Pastries will retain the 50% NON-REFUNDABLE reatiner that was paid at the time of booking. If the cancelation is within two weeks and the final payment has been made, Nita’s pastries will retain 50% NON-REFUNDABLE of the order amount. If cancelation within 1 week of the event,  the amount refunded IF ANY will be determined by Nita’s Pastries. 

Clients understands that Nita’s Pastries can only accept a limited amount of cake /desserts per week, and must turn down other clients in the case the limit is met. In the event that something occurs to affect your scheduled event date, please contact us to discuss options. Communication is key, if you are upfront about any issues, Nita’s Pastries will do it’s best to accommodate your needs.

By paying this invoice above, client agree to all the above terms and condition stated in this contract.
